1. Acceptance of Terms
By downloading, installing, or using Inkwell ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App. These Terms form a binding agreement between you and Shivam Kushwah ("we", "us").
2. Description of Service
Inkwell is a writing application for authoring books, keeping a daily diary, managing to-do lists, and taking notes. Core features work offline.
3. Your Content
- You retain full ownership of everything you write in Inkwell — manuscripts, diary entries, notes, and to-dos ("Your Content").
- We claim no intellectual property rights over Your Content. We do not read, analyze, or use Your Content for any purpose other than storing and syncing it at your direction.
- You are solely responsible for the legality and accuracy of Your Content, and for keeping backups (use the in-app Export feature regularly).
4. Accounts
- An account is only required to use optional cloud sync; core writing features work without one.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You must provide accurate information when creating an account and notify us promptly of any unauthorized use.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or to store content that infringes others' rights
- Attempt to reverse-engineer, decompile, or tamper with the App beyond what is permitted by applicable law
- Use automated means to scrape, overload, or abuse our backend services
6. Intellectual Property
The Inkwell name, logo, App design, and underlying software (excluding Your Content) are owned by Shivam Kushwah and protected by copyright and trademark law. You may not copy, modify, or distribute the App itself without permission.
7. Third-Party Services
The App may rely on third-party infrastructure (e.g., cloud hosting, crash reporting, app store billing) described in our Privacy Policy. We are not responsible for the availability or practices of those third parties beyond our contracts with them.
8. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or uninterrupted/error-free operation. We do not guarantee that cloud sync will always be available or that data loss can never occur — please export/back up Your Content regularly.
9. Limitation of Liability
To the maximum extent permitted by law, Shivam Kushwah shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
10. Termination
You may stop using the App and delete your account at any time (see Data Deletion). We may suspend or terminate access if you violate these Terms, with notice where reasonably possible.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via an in-app notice and/or by updating the "Last updated" date above. Continued use after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your country of residence provide otherwise.
